I2I: Incident to Insight

These Terms of Use ("Terms") govern your use of I2I: Incident to Insight ("the App"), developed and published by Aether Forge ("we," "our," or "us"). By installing or using the App, you agree to these Terms.
I2I is a quality improvement and incident tracking tool designed to help organizations document, investigate, and learn from service delivery incidents. The App provides structured frameworks for root cause analysis, corrective action planning, and organizational learning.
I2I is not a medical device. The App does not provide clinical decision support, medical diagnoses, treatment recommendations, or patient monitoring capabilities. It does not meet the definition of a medical device under FDA regulations (21 CFR Part 820) or the Software as a Medical Device (SaMD) framework.
The App is a business and administrative tool that may be used in healthcare settings. Its investigation frameworks (5 Whys, Fishbone Diagrams) are general-purpose quality improvement methodologies not specific to clinical care.

All data entered into the App belongs to you. Aether Forge does not claim any rights to your data. Because the App stores all data locally on your device, Aether Forge never has access to, possession of, or control over your data.
The App, including its design, code, investigation frameworks, documentation, and branding, is the intellectual property of Aether Forge. You are granted a non-exclusive, non-transferable license to use the App for your internal business purposes. You may not reverse-engineer, modify, distribute, or create derivative works of the App.
The investigation methodologies referenced within the App (5 Whys, Ishikawa Diagrams, PDSA, Just Culture, Swiss Cheese Model, TeamSTEPPS) are established frameworks developed by their respective originators and are referenced for educational purposes.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Aether Forge does not warrant that the App will be error-free, uninterrupted, or free of harmful components. Aether Forge does not warrant that the App will meet your specific requirements or that the investigation frameworks will produce any particular outcome.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AETHER FORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, OR DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE APP, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
IN NO EVENT SHALL AETHER FORGE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP EXCEED THE AMOUNT YOU PAID FOR THE APP.
You agree to indemnify and hold harmless Aether Forge and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
You may stop using the App at any time by uninstalling it and deleting the data folder. Aether Forge reserves the right to modify or discontinue the App at any time without notice.
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Jefferson County, Alabama.
